Definitions for Indiana Divorces

January 19th, 2010 admin

Pretty simple and I think a bit short but let us call Indiana Dissolution of Marriage Definitions a good start. Glossary of Legal Terms exists on our Indiana Courts page at In.gov. Longer and not exclusively geared for family law. Still has a few things that I would add to the first list.

Indiana Child Support Guidelines Explained
DivorceSupport .com has a page here for child support definitions. I think it is a bit of a misnomer – the page is actually a readable explanation of how the Guidelines are to work. I think I better mention that the web page does not appear to take into account any changes in the new Indiana Child Support Guidelines (for those follow this link...
Indiana Child Custody Law – Joint Custody as Sharing
I keep looking for better definitions of joint custody in Indiana. Better meaning a clear, concise explanation distinguishing joint from sole custody. So far, Finnerty v. Clutter (Ind: Court of Appeals 2009) has the best (and the latest) Having determined that the parties have joint legal custody, we conclude that Indiana Code Section 31-17-2-17,...
Indiana Agreements – Modifying Spousal Maintenance
Indiana has no alimony. What we have is spousal maintenance – and the General Assembly has limited when the courts can grant spousal maintenance ( see my article here for more of an explanation). However, the parties can agree to what the courts cannot grant. What then if the parties agree to something – such as maintenance – which...

Getting Divorced in Indiana and The Wife Is Pregnant
This post concerns itself with searching Google Scholar for Indiana case law. I noticed the fallowing query on Google brought someone to this blog: “Indiana divorce law pregnancy”. I assumed the person sought information about what to do when the wife is pregnant after start of the divorce proceedings. Since I do not think that I have...
Indiana Divorce – What Is a Child of The Marriage?
Something here that we lawyers might take for granted but seems to elude non-lawyers. Children from an earlier marriage or relationship are not included as children of the present marriage – even if they are living with you and your spouse. Something trickier occurs when a question arises as to whether the husband is the father of the wife’s...
So You Want to Be Your Own Lawyer
So You Want to Be Your Own Lawyer
Read Re N: How not to write a skeleton from Family Lore . Short post with John Bolch providing a commentary that ought to clarify how to write something going before a judge. Yes, it is English but that makes no difference at all. The legal system is a formal system – regardless of all the Judge Judys on television – there are rules...
Why are Most Divorces Filed by Women?
A generation ago, women were less likely to file for divorce if in an unhappy or abusive marriage. Most were financially dependent on their spouse and feared the social stigma of divorce. Today women are more likely to have careers of their own, are less financially dependent on their spouse and no longer fear the social stigma of divorce. Women...
Indiana Parenting Time Guidelines Cases and Google Scholar
Yesterday I decided to see what Google Scholar has to offer and to combine it with another project – collecting the case law for the Indiana Parenting Time Guidelines . Using the query ” Indiana Parenting Time Guidelines “, I got the following (after eliminating the not-for-publication cases and those that just mention the IPTG without...
Celebrities Without Pre-Nups Face Painful Divorces
The recent announcement that Kelsey Grammer and his wife Camille are divorcing has been big news. What’s an even bigger story is the fact that the multi-millionaire Grammer did not have a prenuptial agreement. A recent article on a pop-culture website gives us a list of the top ten celebrities that didn’t have a prenup when they needed it most....
British Columbia Government Plans to Revise Family Law
The British Columbia government has plans to make what the Vancouver Sun calls “revolutionary changes” to family law in the province. These changes will better reflect modern society, to update the Family Relations Act that was passed 30 years ago. The government’s proposal will revise the legal definition of a parent, and it will update property...
